These Terms and Conditions ("Terms") govern the services provided by Lou-Gra Electrical Test and Tag ("we," "our," or "us") to our customers ("you" or "your"). By engaging our services or using our website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.
1. Scope of Services
1.1 Lou-Gra Electrical Test and Tag provides electrical testing and tagging services for businesses and residential properties, including:
Electrical compliance testing
RCD (Safety Switch) testing
Emergency and exit light testing
Microwave leakage testing
Offsite testing at our Canberra facility
Detailed compliance reporting
1.2 We reserve the right to refuse or discontinue services if we believe the equipment or environment is unsafe or non-compliant with Australian safety standards.
2. Quotes and Pricing
2.1 All quotes provided are valid for 30 days from the date of issue unless otherwise stated.
2.2 Prices are quoted in Australian dollars (AUD) and are inclusive of GST unless specified.
2.3 Any additional services requested or required beyond the initial quote will be charged at our standard rates.
2.4 We reserve the right to adjust pricing based on changes in costs, industry regulations, or the scope of work.
3. Payment Terms
3.1 Payment is required within 14 days of the invoice date unless otherwise agreed in writing.
3.2 If payment is not received within the agreed period, we may charge a late fee of 2% per month on the outstanding balance.
3.3 We accept payment via bank transfer, credit card, or other approved methods.
3.4 We reserve the right to suspend or withhold services until payment is received in full.
4. Cancellations and Rescheduling
4.1 Cancellations must be made at least 24 hours before the scheduled appointment to avoid a cancellation fee.
4.2 A cancellation fee of $100 will apply if the appointment is cancelled within 24 hours of the scheduled time.
4.3 If we are unable to access the site or equipment at the agreed time, a call-out fee may be charged.
4.4 Rescheduling is subject to availability and must be confirmed with us in advance.
5. Customer Responsibilities
5.1 You must provide our technicians with safe and reasonable access to the site and equipment for testing.
5.2 All equipment to be tested must be easily accessible and in working order.
5.3 It is your responsibility to notify us of any hazards or safety issues on the premises.
5.4 We are not liable for delays caused by the customer’s failure to provide access or accurate information.
6. Service Limitations and Warranty
6.1 While we take every reasonable step to ensure accurate testing and tagging, we do not guarantee that equipment will remain compliant or functional after testing.
6.2 Testing and tagging results are valid only at the time of testing.
6.3 We are not liable for equipment failure or damage that occurs after testing unless caused by our direct negligence.
6.4 Any warranty claims must be made in writing within 30 days of the service date.
7. Liability and Indemnity
7.1 To the fullest extent permitted by law, our liability is limited to the cost of the services provided.
7.2 We are not liable for indirect, incidental, or consequential damages, including but not limited to:
Loss of business or revenue
Damage to property
Equipment failure after testing
Data loss
7.3 You agree to indemnify and hold us harmless from any claims, damages, or losses arising from:
Your failure to comply with Australian safety standards
Misuse or improper use of tested equipment
Providing false or incomplete information about equipment or site conditions
8. Intellectual Property
8.1 All service reports, documentation, and testing methods provided by Lou-Gra remain our intellectual property.
8.2 You may use compliance reports for internal business purposes only.
8.3 You are not permitted to modify, reproduce, or distribute our reports or documentation without prior written consent.
9. Confidentiality
9.1 We will treat all information provided by you as confidential unless required by law to disclose it.
9.2 Your data will not be shared with third parties without your consent, except where necessary to deliver our services.
10. Force Majeure
10.1 We are not liable for any failure or delay in service due to causes beyond our reasonable control, including but not limited to:
Natural disasters
Acts of war or terrorism
Industrial disputes
Power outages
Government actions or regulations
11. Termination of Services
11.1 We reserve the right to terminate services if:
You breach these Terms and Conditions
You fail to pay outstanding fees within the agreed period
We believe that continuing the service poses a safety risk
11.2 Termination of services does not affect your obligation to pay for services already rendered.
12. Governing Law
12.1 These Terms and Conditions are governed by the laws of Australia.
12.2 Any disputes or claims arising from these Terms will be resolved under the jurisdiction of Australian courts.
13. Changes to Terms and Conditions
13.1 We may update these Terms and Conditions from time to time.
13.2 Any changes will be posted on our website and will take effect immediately upon posting.
